What is Divorce Mediation?
Mediation is a type of alternative dispute resolution. It is a process through which parties to a legal dispute—including divorcing couples—can meet with their attorneys and a trained mediator in an attempt to work out a settlement. Many divorcing couples in Texas find that mediation is a cheaper, faster alternative to litigation.
For part of the divorce mediation process, each spouse will meet with their attorney in their own private room. The impartial mediator will go back and forth between the rooms in an effort to understand the core issues and to try to facilitate an agreement. When appropriate, all parties will also meet together in an effort to work towards a settlement.
Eight Benefits of Divorce Mediation
For many different reasons, mediation can be an effective way for divorcing couples to resolve their issues. In fact, researchers estimate that approximately 90 percent of family law cases that enter mediation are actually resolved in the process. Why does mediation work well for so many divorce cases in Texas? Here are eight important benefits:
- Non-Adversarial: First and foremost, mediation is not an adversarial process. Even if you are getting a divorce, you and your spouse still share many mutual interests. Mediation allows you to work towards agreeable, collaborative solutions.
- Structured: A trained, impartial mediator can help guide both parties through mediation. The structure of the process helps to keep people from getting stuck on difficult issues.
- Informal: Mediation is far less formal than a trial. The informal, but still structured, environment tends to make people a lot more comfortable.
- Control: There is no “one” way that mediation works. The process can always be customized to meet the unique needs of the parties. Indeed, a divorcing couple will keep full control over mediation. They are not at the whims of a court.
- Confidential: What goes on in mediation can stay in mediation. Divorcing couples do not need to make their issues part of the public record. You can reach a confidential settlement.
- Speed: Mediation can be far faster than litigation. If you and your ex are able to reach an agreement, your divorce can be finalized far more quickly.
- Cost Effective: As you probably know, divorce litigation can be expensive. Mediation is far more cost effective than pursuing the litigation route.
- Voluntary: Finally, mediation is a voluntary process. You may not feel like you can reach a fair agreement with your former partner—and that is fine. You always retain the right to withdraw from divorce mediation and go to court.
